1. Purpose
These Terms of Use (hereinafter "Terms") govern access to and use of the ouFly mobile application (hereinafter "the Application"), published by ouFly SAS. By using the Application, you agree to these Terms in their entirety.
2. Acceptance of Terms
Use of the Application implies full and unreserved acceptance of these Terms. If you do not agree with any of the provisions, you must not use the Application. The Application is intended for users aged 16 and over.
3. Description of the Service
ouFly is a weather information tool designed for aviation enthusiasts. It provides weather data, wind forecasts, spot management, and session planning features. The information provided is for informational purposes only and does not constitute flight advice. Users are solely responsible for verifying conditions and flight legality before any flight.
4. User Responsibilities
Users agree to: (a) provide accurate information during registration; (b) maintain the confidentiality of their credentials; (c) use the Application in compliance with applicable laws and regulations; (d) not attempt to disrupt, reverse-engineer, or compromise the Application's security. ouFly cannot be held liable for any incident related to a flight decision made based on information provided by the Application.
5. Intellectual Property
All content, design, logos, and software of the Application are the exclusive property of ouFly SAS or its licensors and are protected by intellectual property laws. Any reproduction, modification, or distribution without prior written consent is prohibited.
6. Personal Data
The processing of personal data is governed by our Privacy Policy, accessible at any time from the Application and our website. We encourage you to read it carefully.
7. Modifications to Terms
ouFly SAS reserves the right to modify these Terms at any time. Users will be notified of significant changes via the Application or email. Continued use of the Application after modification constitutes acceptance of the new Terms.
8. Service Availability and Interruption
The Application is provided "as is" without any guarantee of permanent or uninterrupted availability. ouFly SAS reserves the right to suspend, modify, or permanently discontinue all or part of the service, at any time, for technical, economic, force majeure, or any other legitimate reason, with a minimum 30-day notice communicated by email or through the Application. In the event of permanent discontinuation of the service, users with an active subscription will be refunded on a pro rata basis for the remaining unused period. The liability of ouFly SAS shall not exceed the amount of the current subscription for any damage resulting from the interruption or discontinuation of the service.
9. Applicable Law & Jurisdiction
These Terms are governed by French law. Any dispute arising from the use of the Application shall be subject to the exclusive jurisdiction of the courts of Paris, France, unless mandatory consumer protection rules provide otherwise.
