Terms of Sale

1. Purpose

These Terms of Sale govern the subscription to the ouFly Pro plan, a paid service offering premium features within the ouFly application.

2. Pro Subscription

The ouFly Pro subscription provides access to premium features including: detailed weather forecasts, full spot details with Fly-Check, session participation, and escadrille creation. Two plans are available: Monthly and Yearly. Prices are displayed in the Application before purchase and may vary by region.

3. Auto-Renewal

Subscriptions are automatically renewed at the end of each billing period (monthly or yearly) unless cancelled at least 24 hours before the end of the current period. The renewal is charged at the same rate as the initial subscription unless you are notified of a price change.

4. Right of Withdrawal

In accordance with applicable consumer protection laws, you have a 14-day right of withdrawal from the date of subscription. However, if you have explicitly consented to the immediate provision of the service and acknowledged loss of withdrawal rights, the right of withdrawal may not apply once the service has been fully provided.

5. Payment Methods

Payments are processed through the platform's payment infrastructure (Apple App Store, Google Play Store, or Polar for web). ouFly does not directly store credit card information. All transactions are secured by the respective payment providers.

6. Cancellation

You may cancel your subscription at any time through: (a) the Application's subscription management page; (b) your Apple App Store or Google Play Store subscription settings; (c) the Polar customer portal for web subscriptions. Upon cancellation, you retain access to Pro features until the end of the current billing period.

7. Refunds

Refund requests are handled according to the policies of the platform through which the purchase was made (Apple, Google, or Polar). For web subscriptions, refund requests can be submitted to support@oufly.app within 14 days of purchase.

8. Service Interruption or Discontinuation

ouFly SAS reserves the right to suspend or permanently discontinue the ouFly Pro service for technical, economic, force majeure, or any other legitimate reason. In the event of permanent discontinuation, ouFly SAS commits to: (a) notifying users with a minimum 30-day notice by email and through the Application; (b) refunding on a pro rata basis the remaining unused subscription period for any active subscription (monthly or yearly); (c) providing users with the ability to export their personal data before closure. Refunds will be processed via the original payment method within 30 days following the effective date of service discontinuation.

9. Limitation of Liability

In the event of service interruption or discontinuation, the liability of ouFly SAS is strictly limited to the pro rata refund of the unused subscription period. ouFly SAS shall under no circumstances be held liable for any indirect damages, data loss, loss of profits, or moral damages resulting from the interruption or discontinuation of the service, to the extent permitted by applicable law.

10. Applicable Law

These Terms of Sale are governed by French law, in compliance with European consumer protection regulations. Any dispute shall be subject to the jurisdiction of the courts of Paris, France, without prejudice to mandatory consumer protection rules of your country of residence.
